The police officer died last year while he was investigating a flooded manhole cover during a heavy rainstorm. A drunk driver ran into the police officer before driving off. While the driver is being held responsible for the officer’s death, the family argues that the city of Chattanooga also plays a part in the death of their son. The lawsuit points out that a year before this police officer’s death, the city paid out a large amount of money for damages to a car that hit the same manhole after a rainstorm. According to the lawsuit, the city of Chattanooga was aware of the problem with the manhole but failed to replace the faulty cover or properly implement safety procedures.
