How misdiagnosis and medication errors can harm victims

This blog recently discussed who bears responsibility for a medical malpractice claim but it is also important to understand the different types of medical malpractice claims that may be available for the different types of medical malpractice that may cause harm to victims. Misdiagnosis as well as medication errors are types of medical malpractice that can cause serious harm to victims who should be familiar with the legal protections available to them.

When medical care professionals fail to follow the standard of care and cause harm to victims, they may be liable for the damages suffered by victims. When a misdiagnosis or medication error has resulted in a worsened condition or other injury to the victim, which can sometimes be catastrophic or even fatal, they may be able to pursue compensation for their damages through a medical malpractice claim for damages.

Medication errors can occur when a prescription is incorrect either because the victim has been overprescribed or under-prescribed; the victim was prescribed the incorrect dosage; a prescription was prescribed with the wrong medical or the wrong dosage of the correct medication; or the wrong dosage was administered.

Likewise, victims of medical malpractice can suffer harm including delayed diagnosis or delayed treatment; a failure to diagnose or failure to treat; a failure to conduct appropriate tests or correctly interpret tests; a failure to refer to a specialist when needed; and in other circumstances as well such as the receipt of treatment or care the victim did not need because of a misdiagnosis. When diseases are timely and properly diagnosed, they are more likely, of course, to be timely and properly treated which can lead to better outcomes for the patient.

A medical malpractice claim for damages can be tremendously helpful to victims but can also be complex and may come at a challenging time for victims. As a result, victims of medical malpractice and their families should thoroughly understand the legal protections to help them guard against the harm caused by medical errors and the value of trained guidance through the process.
