Protections for victims of medical malpractice

Medical malpractice such as a misdiagnosis can lead to fatal consequences for victims. Misdiagnosis, a failure to diagnose or a delayed diagnosis can result in a worsened condition, causing the victim pain, additional cost and can result in death as well.

Medical malpractice law provides protections for victims of a misdiagnosis, failure to diagnose or a delayed diagnosis. When a medical care provider fails to meet the standard of care and a victim is injured as a result, the medical care provider may be liable to compensate the victim for their damages. In circumstances when the misdiagnosis, failure to diagnose or delayed diagnosis leads to disease progression beyond what normally would be expected had the disease been properly and timely diagnosed, the victim may be able to recover compensation for their physical, financial and emotional damages.

An improper diagnosis can also lead to medication errors. In some circumstances, a patient who is improperly diagnosed will receive care, treatment or medication they do not need which can worsen their condition. At the same time, they will not receive the medical care, treatment and medication that they do need to treat their condition. A negligent medical care provider may be liable to victims for a failure to treat; delayed treatment; a failure to conduct appropriate tests; a failure to provide the appropriate referrals to specialists; and a failure listen for the patient's symptoms and medical history.
