New Tennessee distracted driving law aims to reduce fatalities

Distracted driving is dangerous behavior on the roadways and results in accidents, injuries and deaths. A new law going into effect in Tennessee at the beginning of July will make it illegal to touch a cellphone while driving. A recently launched campaign is aimed at eliminating distracted driving-related fatalities in Tennessee.

According to the campaign to reduced distracted driving-related fatalities in Tennessee, there were 24,600 distracted driving-related accidents in Tennessee during 2018. A recent study that examined the years from 2015 to 2017 reported that Tennessee had the highest rate of distracted driving deaths in the nation. In Tennessee there were 7.2 distracted driving deaths per 10 billion vehicle miles. Tennessee's rate is nearly five times higher than the national rate, which sits at 1.48 distracted driving deaths per 10 billion vehicle miles.

Wrongful death protections for medical malpractice victims

Wrongful death legal protections are available when a family member or loved one has been killed because of the negligence of doctor, nurse, hospital or other medical care professional. These are important protections to be familiar with when a loved one has died because of a medical error.

A wrongful death claim for damages can help surviving family members with their emotional and financial damages suffered because of the unexpected loss of a loved one due to medical malpractice. Damages may include pain and suffering; medical and funeral expenses; loss of consortium and loss of companionship; lost prospect of inheritance; loss of past and future wages and earning capacity; and loss of support and services, as well as other damages depending on the circumstances.

Beware the distracted drivers on Tennessee roadways

If you're a baby boomer or older, you might recall a time in your past when it was customary to go for Sunday drives or leisurely excursions, "just because." People rarely do such things anymore and one of the reasons might be that it is highly dangerous to navigate Tennessee highways. Nowadays more traffic, faster speed limits and many distracted drivers pose great risk to everyone on the road.

Perhaps you still enjoy drives in the countryside from time to time. You may also commute to work or drive your kids to sporting events and other activities. Not many people go through life without driving. That's why it's a good idea to practice safe driving habits and to be alert so that you can spot potential trouble if a distracted driver happens to be nearby. Distracted driving accidents often result in severe injuries, and if someone hits you, you may be in for a long, arduous recovery.

What kinds of damages can I recover after a car accident?

An unexpected car accident can change the lives of victims in an instant and leave them wondering what to do about the damages they have suffered. It is important for auto accident victims to know that they may be able to recover compensation for the harm they have suffered. However, they may wonder what specific types of damages they may be able to recover.

Car accident damages can include compensation for the car accident victim's physical, financial and emotional damages. The victim may be able to recover compensation for ambulance fees; visits with doctors and medical care professionals; physical and cognitive therapy; medical care accessories; disfigurement; permanent disability; and medical care and treatment needed in the home. In some circumstances, compensation for ongoing medical care and future medical care costs may be available.

Never try to walk off non-economic damages

Most people have probably heard of getting compensation after an accident. The cost of your medical bills or repairing your car after a collision are the types of compensation that tend to jump to mind. These “economic damages” reimburse a specific dollar amount based on the cost of the services.

These differ from “non-economic damages.” You can receive non-economic damages if an accident leaves you with scars, unable to be there for your family, or unable to enjoy life as you once did.

Help keep motorcyclists safe and watch out for them on the road

Unfortunately, motorcycle accidents occur everyday and the number of them can increase as the weather improves. May is Motorcycle Safety Awareness Month so it is a good time to look at ways to help keep motorcycle riders safe and to take a closer look at how they are protected.

Motorcycle and auto accidents can result in serious injuries and harm to victims. Too many motorcycle accidents take place because a distracted or inattentive driver is not paying attention and fails to see the motorcycle rider. Drivers in these circumstances can negligently cause a motorcycle accident and may be liable to compensate victims for their damages. Depending on the nature of the accident and harm suffered by the victim, victims may suffer a variety of physical, financial and emotional injuries.

How misdiagnosis and medication errors can harm victims

This blog recently discussed who bears responsibility for a medical malpractice claim but it is also important to understand the different types of medical malpractice claims that may be available for the different types of medical malpractice that may cause harm to victims. Misdiagnosis as well as medication errors are types of medical malpractice that can cause serious harm to victims who should be familiar with the legal protections available to them.

When medical care professionals fail to follow the standard of care and cause harm to victims, they may be liable for the damages suffered by victims. When a misdiagnosis or medication error has resulted in a worsened condition or other injury to the victim, which can sometimes be catastrophic or even fatal, they may be able to pursue compensation for their damages through a medical malpractice claim for damages.

Who is responsible in a medical malpractice claim?

Understanding who is responsible for the injuries and harm victims of medical malpractice have suffered is important. It can help ensure victims of medical malpractice are made as whole as possible after the harm they have suffered when seeking medical care and treatment.

When seeking medical care and treatment, patients should be able to rely on the care they receive. Unfortunately, it is not always the case that patients receive medical care without suffering harm which is why a medical malpractice claim for damages may be able to help with the physical, financial and emotional damages they suffer as a result. When a victim has suffered negligent medical care, it is important that negligent medical professionals are held accountable which is why victims should understand who may be liable for the harm they have suffered.

What a wrongful death claim can do for surviving loved ones

Wrongful death legal protections are invaluable for surviving family members of loved ones who have been wrongfully killed in a fatal accident. A wrongful death claim for damages is a type of personal injury claim that is brought on behalf of the estate of the lost loved one for the benefit of surviving family members to help them with the financial and emotional damages they have suffered as a result of the unexpected loss of their loved one.

Wrongful death protections can apply in a variety of circumstances including fatal car accidents, fatal motorcycle accidents, fatal truck accidents, medical malpractice and in other situations and circumstances as well. A wrongful death claim for damages can help surviving family members recover compensation for damages including loss of support and services; loss of companionship; lost prospect of inheritance; and medical and funeral expenses.

Personal injury legal protections are available for victims

Though a personal injury claim for damages can be a vital resource to many victims and families suffering the after-effects of a traumatic accident, they can also carry a variety of complexities that victims such as car accident victims should be familiar with. Victims can be left struggling with serious injuries with little idea what to do about the medical expenses, lost wages, and emotional damages they suffer.

Personal injury legal protections are the way that the legal system protects victims and helps them with their damages when they have been harmed by a negligent party, such as a distracted or drunk driver. Having trained guidance through the personal injury legal process can be helpful. The process involves the filing of a complaint, investigation of the accident, preserving and evaluating evidence, and consulting with experts. It may also involve dealing with insurance companies and engaging in settlement negotiations.
